Agency terms
What ekrily and car rental agencies commit to: verification, availability, commission and invoicing.
Updated 12 October 2026On this page
1.Purpose
These terms govern how car rental agencies use the ekrily Agence dashboard and appear on the ekrily marketplace. The agency accepts them when it signs up.
2.Sign-up and verification
Only companies running a car rental business can sign up. The agency provides:
- its National Business Register (RNE) extract and tax certificate;
- the receipt of its rental business declaration;
- its manager’s ID and a bank account certificate.
ekrily checks these documents before anything is published and may refuse a sign-up, giving its reasons. For every listed car, insurance, roadworthiness inspection and operating permit must be valid.
3.Services
The dashboard (fleet, planning, off-platform bookings, team, several pickup points) is free, with no limit on cars or branches. Listing on the marketplace brings ekrily bookings. Optional paid plans may be offered; managing availability will never be paid.
4.Agency commitments
- Keep availability up to date, including off-platform rentals and blocked periods.
- Hand over the model booked, with the gearbox and fuel booked.
- Collect at the counter the amount on the booking voucher, with no unannounced extra.
- Apply the deposit stated, without guarantee cheques, and return it within 48 hours unless damage or a fine is documented.
- Reply to booking requests within one hour.
- Use customer data only for the rental, under Organic Law No. 2004-63.
5.Commission
For every rental booked on ekrily and completed, the agency owes a commission of 8% of the price excluding VAT and the 2 TND per day levy. The rate is the one in force when the booking was made.
- Rentals recorded off-platform never carry commission.
- Founding Partners pay 0% commission until 31 August 2027.
- The service fee paid by the customer belongs to ekrily; the rental price and the deposit are collected by the agency directly.
6.Invoicing and payment
On the 1st of each month, ekrily issues a commission invoice for the rentals completed the previous month, with 19% VAT and stamp duty. It is payable by bank transfer within 15 days. If the agency applies withholding tax, it sends the corresponding certificate.
If payment is late and after a reminder, ekrily may suspend the agency’s listings until it is settled.
7.Cancellation by the agency
An agency that cannot honour a booking must tell the customer at least 24 hours in advance (article 35 of Law No. 2000-83). When the ekrily guarantee applies:
- rebooking costs paid by ekrily may be charged back to the agency, up to 300 TND if notice is under 72 hours;
- the agency’s badge may be suspended for 30 days;
- three incidents in 12 months lead to removal from the marketplace.
When a customer doesn’t show up, the agency receives a credit equal to 50% of the service fee excluding VAT, offset on its next invoice.
8.Personal data
Each party is responsible for the processing it carries out. Building or sharing lists of “risky” customers or data about offences is forbidden (articles 13 and 47 of Organic Law No. 2004-63).
9.Suspension and termination
The agency may close its account at any time; confirmed bookings remain due. ekrily may suspend an agency, stating the reason, for an expired document, a breach of these terms, repeated complaints or fraud. Its offers are then hidden; confirmed bookings are kept or handled under the ekrily guarantee.
10.Governing law
These terms are governed by Tunisian law. Failing an amicable agreement, the courts of Tunis have jurisdiction.
